In the first action, the plaintiff alleged that she slipped and fell in a hospital bathroom due to a wet floor and claimed that, as a result, she suffered an extensor tendon tear of her right elbow, medial and lateral meniscus tears of her right knee, and a rotator cuff tear of her right shoulder, requiring six arthroscopic procedures. Following a four-day trial, the jury unanimously found that there was no negligence whatsoever by the hospital and returned a defense verdict.
In the second action, the plaintiff alleged that she slipped and fell in a hospital Emergency Department due to wetness and claimed that, as a result, she suffered disc herniations, disc bulges, and a midline annular tear, requiring extensive surgery, including lumbar microdiscectomy. She also alleged that she suffered from complex regional pain syndrome and was permanently disabled. The plaintiff’s demand prior to trial was $3.25 million. Following a four-day trial, the jury – on the first question on the verdict sheet – unanimously found that there was no wetness on the floor and returned a defense verdict.”
