FKB’S Hillary C. Agins successfully obtained another summary judgment and dismissal of a plaintiff’s medical malpractice action against a physician. The case involved allegations of negligence related to the treatment of the plaintiff’s subdural hematoma, which included surgery performed by the neurosurgery team. 

Hillary successfully argued that the FKB defendant, a consulting neurologist who followed the patient post-operatively, did not depart from accepted standards of care during his consultations; the consulting neurologist’s role was limited in that he did not assume responsibility for the patient’s overall management, and he could not be at fault if the attending doctors on the neurosurgery team declined to follow his recommendations.
