FKB‘s Jennifer Y. Gutterman obtained a directed verdict for a hospital in Supreme Court, Dutchess County before Judge Charles Wood. The case involved complications from a robotic assisted laparoscopic hysterectomy performed by two codefendant physicians.

During the trial, after plaintiff rested, Jennifer obtained dismissal of the direct claims against the hospital. At the end of the trial, Judge Wood granted Jennifer’s motion for a directed verdict and dismissed the remaining claims for vicarious liability which had been brought under the doctrine of ostensible agency or agency by estoppel.
