FKB’s John Gizunterman successfully obtained summary judgment and dismissal of plaintiff’s medical malpractice action against FKB clients, a major New York City hospital network and several providers affiliated with the facility.

This action involved allegations concerning failure to diagnose a femur bone cyst during the course of treatment for a displaced patella allegedly resulting in a subsequent proximal third femur fracture with displacement. In obtaining the dismissal FKB successfully argued that the treating providers properly addressed the trauma induced injury and there was no reason to suspect a femur tumor throughout the course of treatment.
