FKB’s Neil Kornfeld obtains a defense verdict in a podiatric medical malpractice action in Supreme Court, New York County. Plaintiff, a 40 year old woman, claimed that the defendant doctor negligently performed foot surgery causing traumatic arthritis, two subsequent surgeries, and the need for a third surgery. The defendant doctor performed bilateral Akin osteotomies and multiple hammertoe surgeries. Plaintiff’s expert testified that the plaintiff’s injury is permanent and will eventually require another surgery.
