FKB’s Neil Kornfeld obtains a defense verdict on behalf of a hospital in Supreme Court, Dutchess County. Plaintiff claimed that the defendant Hospital and ER staff failed to timely diagnose a bowel perforation resulting in sepsis and multiple surgeries. Plaintiff alleged that she presented to the hospital with an acute abdomen requiring a surgical consult and the the plaintiff was negligently discharged. The defense argued that discharge was appropriate based on the repeated exams of the abdomen, normal vital signs, and imaging results.
