FKB’s Rachel Aghassi and Christopher D. Skoczen obtained the dismissal of an appeal to the Second Circuit Court of Appeals of an Order dismissing an action against FKB’s client law firm, alleging, inter alia, fraud, civil rights violations, and violations of the Racketeer Influenced and Corrupt Organizations Act. The Second Circuit upheld the findings of the U.S. District Court, Eastern District of New York (District Court Judge Pamela K. Chen) that the plaintiff/appellant had not obtained personal jurisdiction over the law firm in failing to serve the firm in compliance with the requirements of the Federal Rules of Civil Procedure. The Second Circuit found that the appeal lacked an arguable basis in law or fact.
