FKB’s John Gizunterman and  Christopher Tohir successfully obtained summary judgment in Bronx County Supreme Court on behalf of a New York teaching hospital and several physicians in an action where plaintiff alleged the defendants negligently performed a tubal ligation and cesarean section resulting in nerve damage to plaintiff’s bilateral lower extremities. After extensive discovery and three favorable expert reviews, FKB was able to establish that there was no deviation from obstetric or anesthesia standards of care in the performance of the surgery and that the neurological injuries alleged could not have been caused by the at-issue procedure.
