FKB’s Tracy S. Katz obtains a discontinuance of a medical malpractice action upon service of a motion for summary judgment. The case involved claims that defendants failed to prevent, diagnose and treat the patient’s ankle ulcers leading to infection, sepsis, the need for an above the knee amputation, multiorgan failure and wrongful death.   FKB represented a defendant internal medicine physician.  FKB moved for summary judgment arguing that our client’s involvement was entirely within the standard of care and not the proximate cause of the patient’s alleged injuries or death.  In the face of FKB’s motion, plaintiff’s counsel agreed to discontinue the action against FKB’s client.
