FKB’s Aaron M. Barham Presents CLE on Ethical Considerations in New York Real Estate Closings
FKB partner Aaron M. Barham presented a Continuing Legal Education (CLE) program titled “New York Real Estate Closings from Start to Finish” on May 27, 2026, addressing the ethical considerations and risk management issues that arise throughout the closing process.
Real estate closings present some of the most recurring sources of professional liability exposure for New York attorneys. Aaron’s section addressed conflicts of interest, trust account obligations, good faith duties in closing documents, and cyber fraud and wire scams. The session emphasized practical takeaways applicable to any real estate practice: crafting engagement letters that clearly define scope, identifying conflicts and securing waivers before they become problems, and the principle that thoroughness and effective documentation are often the most effective safeguards against a malpractice claim.
