FKB’s John Gizunterman and Ita Parnass successfully obtained summary judgment and dismissal of plaintiff’s medical malpractice action against FKB client, a major New York City hospital network and several physicians affiliated with the facility.

This action involved allegations concerning failure to treat kidney stones, obstructive uropathy, and a calcified ureteral stent over a series of ER visits, resulting in septic shock,  hypotension and ultimately amputation of bilateral legs, and wrists.  FKB successfully argued that the FKB defendants did not deviate from the standard of care during plaintiff’s three emergency room visits because plaintiff was evaluated for potential emergencies and counseled on non-emergent follow-up care necessary to relieve the underlying stone.
