FKB’s Neil Kornfeld obtains a defense verdict on behalf of an ER physician in Supreme Court, Queens County. Plaintiff alleged the defendant ER physician failed to timely diagnose and treat a stroke. Plaintiff claimed that the ER physician failed to order a stat neurology consult and order frequent neurological checks causing a delay in administering TPA. The defense successfully argued that the ER physician appropriately monitored plaintiff’s condition and ordered the appropriate tests and consults. Plaintiff’s alleged injuries included: hemiparesis, stroke, deep vein thrombosis, dysphagia, dysarthria, paralysis, aphasia, poor coordination, lack of concentration, facial asymmetry, difficulty ambulating, difficulty using left arm and hand, and depression.
