Tracy S. Katz Obtains Summary Judgment On Behalf Of A Podiatrist In A Case Alleging A Failure To Diagnose And Treat Hip Dysplasia


Tracy S. Katz obtains summary judgment in a case involving the alleged failure to diagnose and treat hip dysplasia in a minor child.  Plaintiff claimed that the delay in diagnosis allowed the hip to become severely displaced requiring 3 subsequent surgeries and permanent pain and suffering.  Despite three experts (two by the plaintiff and one by the co-defendant) opposing FKB’s motion, the Court agreed with our arguments and dismissed this action against FKB’s client in its entirety.  The Court agreed that the failure to diagnose and treat hip dysplasia is outside the scope of a podiatrist.  The Court further found that all of the other claims alleged by the plaintiff lacked specificity or evidentiary support or were improperly pled.
