Tracy S. Katz successfully secures a discontinuance on behalf of a radiology facility in an alleged failure to diagnose lung cancer case.

Plaintiff alleged that numerous medical professionals failed to diagnose and treat her lung cancer.  The plaintiff’s pulmonologist, a co-defendant, referred her to FKB’s client, a radiology facility, for serial CT scans over the course of 8 years.  FKB’s radiology clients appropriately identified two right upper lung nodules and reported that they appeared to be increasing in size and that neoplasm/recurrent disease could not be excluded.  Tracy S. Katz was able to secure a discontinuance on behalf of FKB’s clients, arguing that as the patient’s radiologists, they appropriately identified and reported on the CT findings and deferred to the plaintiff’s treating clinical providers for management of the radiology findings.
